Competition Terms and Conditions

  1. The promoter of the Competition is Bank of Western Australia Ltd ABN 22 050 494 454, AFSL 236872 of Level 35, 108 St Georges Terrace, Perth WA 6000 (“BankWest”).
  2. Entry to the Competition is only open to individuals who are residents of Western Australia.
  3. Directors and employees of BankWest, its agencies and companies associated with the Competition including their immediate families (including spouses, defacto spouses, parents, natural or adopted children and siblings (whether natural or adopted by a parent) and whether or not they live in the same household as the employee or director), are ineligible to enter the Competition.
  4. Entry to the Competition is by registering and uploading a photograph taken by the entrant in Western Australia at www.bankwestphoto.com.au in accordance with these Terms and Conditions and the directions contained on the website at www.bankwestphoto.com.au.
  5. Entry to the Competition opens at 6.00am (WST) on 26 February 2007 and closes at 4.00pm (WST) on 14 April 2007.
  6. From the entries received, BankWest will select four (4) winners (“Winners”) of the Competition on 21 April 2007 and will notify those Winners by phone using the phone number supplied with the entry.
  7. The Winners will each receive AUD$500 in a BankWest Instant Saver Account and the winning photographs will appear on a BankWest ATM card, at BankWest's discretion. The Winners each agree to participate in BankWest's promotion of the BankWest ATM card and the Competition. If BankWest cannot contact a Winner within two (2) business days of the decision, it may select, from the entries received, a new Winner.
  8. Winners will be required to open a BankWest Instant Saver Account, into which their AUD$500 prize will be deposited. A BankWest Instant Saver Account can be opened by visiting a local BankWest Branch and following the account opening procedures. BankWest's Instant Saver Account Terms and Conditions and Product Disclosure Statement are applicable to the opening, operating and closing of a BankWest Instant Saver Account. The BankWest Instant Saver Account is not available for business customers. The BankWest Instant Saver Account Terms and Conditions and Product Disclosure Statement can be viewed in full at www.bankwest.com.au.
  9. If a Winner of the AUD$500 prize is under the age of 12 years, the prize must be awarded to his/her parent or guardian and the BankWest Instant Saver Account must be opened in the name of that parent or guardian.
  10. From 26 February 2007, members of the public will also be entitled to view and vote for their favourite photograph entered in the Competition. For a period of 6 weeks, commencing on 26 February 2007, the entrant that received the highest number of votes from members of the public during that week, as determined by BankWest, will receive a cash prize of AUD$250 (“Public Choice Winner”). There are six cash prizes of AUD$250 to be awarded to Public Choice Winners. The first weekly prize will be awarded on 5 March 2007 and the final weekly prize will be awarded on 9 April 2007. Public Choice Winners will be notified by phone using the phone number supplied with the entry. If BankWest cannot contact a Public Choice Winner within two (2) business days of the decision, it may award the weekly cash prize to the entrant that received the next highest number of votes during that week as determined by BankWest.
  11. BankWest's decision is final (including in relation to its attempts to contact any Winner or Public Choice Winner) and no correspondence will be entered into, including in the event of a dispute.
  12. BankWest accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by any winners of the Competition.
  13. All photographs entered in the Competition become the property of BankWest and BankWest, its agencies and companies may use any photograph entered in the Competition without restriction including on a website or on other publications, promotional materials or advertisements and without making payment to the entrant or any other person or attributing the entrant as the author of the photograph. BankWest may also allow or license others to use photographs for these purposes and may receive payment for this. The entrant warrants that he/she has the authority to grant these rights to BankWest.
  14. The entrant warrants that he/she is the author of the photograph entered in the Competition and owns all rights, including intellectual property rights in the photograph and that by providing the photograph to BankWest and allowing BankWest to use the photograph in accordance with these Terms and Conditions, he/she is not breaching any law or the rights of any person and has obtained all necessary consents. The entrant waives all moral rights in the photograph and allows BankWest to deal with the photograph in any other way that may otherwise be in breach of his/her moral or other rights.
  15. BankWest will not be liable to any entrant for any loss or damage whatsoever (including but not limited to indirect or consequential loss) caused directly or indirectly by the entrant having entered the Competition or any use of the entrant's photograph by BankWest, except for any liability which cannot be excluded by law.
  16. The entrant indemnifies BankWest against any damage or loss arising from the use of his/her photograph, including claims for negligence or any breach of these Terms and Conditions.
  17. If for any reason the Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of BankWest which corrupts or affect the administration, security, fairness, integrity or proper conduct of the Competition, BankWest reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process, and, subject to any written directions given by the Gaming and Wagering Commission, to cancel, terminate, modify or suspend the Competition.

What is the BankWest Instant Saver Photo competition?

The BankWest Instant Saver Photo competition is your chance to upload your favourite photo image of Western Australia into the BankWest Instant Saver Gallery for your chance to win $500.

When can I enter the BankWest Instant Saver Photo Competition?

The BankWest Instant Saver Photo competition will be open to the general public from March 1st to April 14th. The winner of the BankWest Instant Saver Photo Competition will be notified on April 21st.

How do people enter?

People can enter the BankWest Instant Saver Photo competition by submitting a photo image into the uploader, completing their details, agreeing to the terms and conditions and clicking the submit button. Entry into the competition is FREE and only available online at www.bankwestphoto.com.au.

Who can enter?

Entrants must be at least 12 year old and have complete copyright ownership over the submitted image to enter the competition. Photo submissions must have permission from all people appearing in the photo before a photo can be submitted.

How do I remove a submitted entry?

If you submit a photo and you later decide that you want it removed from the gallery simply email Bankwest.Photo@bankwest.com.au. Any photos removed from the gallery will result in an invalid entry and the user's total entry will be removed from the competition.

My image appears in a photo that has been submitted but I don't want it online, how do I get it removed.

Email Bankwest.Photo@bankwest.com.au and we will suspend the image until we speak with the owner of that image. Should the owner not be able to prove total ownership over the competition submission the image will be removed from the gallery.

What are the prizes?

Each fortnight the photo that has been awarded the highest rating by popular vote will be deemed the winner of the BankWest Instant Saver Photo competition and will win the people's choice award and receive a BankWest Instant Saver Account and $250. The winner of the Major Prize will be selected by a panel of judges and win a BankWest Instant Saver Account and $500. There will be one major prize winner and six people's choice winners during the course of the competition

How Do I Vote?

To vote simply visit the BankWest Instant Saver Photo Gallery and view the photos that has been submitted. Under each photo will be a star rating system that you can use to place your vote. The best photos should be awarded up to five stars; the worst photos should be awarded no less than one star.

How can I get more votes on my picture?

Tell your friends that you have submitted your photo to the BankWest Instant Saver Photo competition www.bankwestphoto.com.au and ask them to vote for your image.
